BREAKING: Senator Smith Files Medical Homegrow Bill — A Historic Step Toward Patient Freedom in Florida



Florida medical cannabis patients just received some incredible news — and Suncoast NORML is proud to break it.


This week, Senator Carlos Guillermo Smith filed SB 776, a bill that would finally grant qualified medical marijuana patients the right to legally grow their own cannabis at home. After years of advocacy, countless stories from patients struggling with affordability and access, and ongoing calls for a more compassionate medical program, Florida lawmakers now have a real opportunity to bring homegrow to the Sunshine State.

This is the moment Florida patients have been waiting for.



What SB 776 Would Do

SB 776 creates a clear, patient-centered framework for medical home cultivation. Under the bill:


✔ Patients 21+ could grow up to six flowering cannabis plants at home

For personal use only — strictly noncommercial. This gives patients the autonomy to cultivate the medicine that works best for them.


✔ Patients could buy seeds and clones from licensed Medical Marijuana Treatment Centers

No risky online seed purchases or gray-market workarounds — legal, regulated access.


✔ Plants must be secured

Patients must take reasonable steps to prevent unauthorized access, keeping homes safe and compliant.


✔ All existing medical-use restrictions remain in place

Personal consumption of homegrown cannabis would still follow the rules in Florida’s medical cannabis laws.


✔ Selling homegrown cannabis remains illegal

The bill is tightly focused on patient cultivation — not creating an unregulated market.

SB 776 would take effect July 1, 2026, if passed.



Why Homegrow Matters


For years, Florida patients have been limited to buying products exclusively from vertically-integrated, corporate cannabis operators — some of the most expensive medical cannabis in the country.


Homegrow is about:

  • Patient affordability

  • Medical autonomy

  • Strain accessibility for patients with unique medical needs

  • Ending criminalization of patients for growing their own medicine

  • Aligning Florida with the majority of medical states that already allow home cultivation
